Boating under the influence (BUI) in Florida is a serious crime as the state prohibits operating of vessels while under the influence of drugs or alcohol. A vessel, in this case, is defined as any form of water transportation. BUI convictions are applicable when an individual’s normal capability is affected by drugs, alcohol or both and has a breath alcohol concentration (BAC) of .08 percent or higher.
Florida BUI penalties vary and are determined based on whether the accused has excessive BAC or had prior BUI or DUI convictions. Other considerations include whether a boat operator has caused or contributed to an accident that caused property damage, injury or death and if they had a passenger below 18 years of age at the time of committing the offense.
